These Terms of Service ("Terms") govern your use of bmtcreations.in and the software development and IT services provided by BMT Creations Private Limited ("BMT Creations", "we", "us"). By using this website or engaging our services, you agree to these Terms.
1. Services
We provide mobile app development, website and web application development, AI integration, IT consultancy, hosting and maintenance services. The exact scope, deliverables, timeline and price for each engagement are set out in a written proposal, quotation or agreement ("Proposal"). If a Proposal conflicts with these Terms, the Proposal prevails.
2. Quotes and payment
- Prices are in Indian Rupees and exclusive of GST unless stated otherwise. GST is charged as applicable.
- Unless the Proposal says otherwise, projects require an advance payment before work begins, with the balance due on delivery or at agreed milestones.
- Invoices are payable within 7 days. We may pause work on overdue accounts.
- Maintenance and hosting plans are billed in advance for each period.
3. Client responsibilities
You agree to provide content, access, approvals and feedback on time, and you confirm you have the rights to any material (text, images, logos, data) you give us. Delays in providing these may change the timeline.
4. Changes to scope
Work outside the agreed scope is quoted separately and started only after your approval.
5. Intellectual property
On full payment, ownership of the custom deliverables created specifically for you transfers to you. We keep ownership of our pre-existing tools, libraries, templates and know-how, and grant you a perpetual licence to use them as part of your deliverables. Third-party and open-source components remain subject to their own licences. Unless you ask us not to, we may mention the project in our portfolio without disclosing confidential information.
6. Confidentiality
Each party will keep the other's non-public business information confidential and use it only for the engagement.
7. Warranty and support
We fix defects in our deliverables reported within 30 days of delivery at no extra cost. Ongoing support, updates and hosting are available under a maintenance plan. We do not guarantee that software will be error-free or uninterrupted, or specific business results.
8. Third-party services
Projects may rely on third-party services (for example Google Play, hosting providers, payment gateways, AI APIs). Their availability, pricing and policies are outside our control, and their fees are payable by the client unless the Proposal says otherwise.
9. Limitation of liability
To the extent permitted by law, our total liability for any claim relating to an engagement is limited to the fees you paid for that engagement in the 12 months before the claim. We are not liable for indirect or consequential losses such as lost profits or data.
10. Use of this website
The content on this website is for general information. You may not misuse the website, attempt to disrupt it, or copy its content for commercial use without permission.
11. Governing law
These Terms are governed by the laws of India. Courts at Krishnagiri, Tamil Nadu have exclusive jurisdiction.
